Overview
A unicorn fintech that has recently IPO’d is seeking a US Privacy Counsel to join its high-performing global legal team. This role will support the business on a wide range of US privacy and data protection matters, collaborating closely with colleagues across the US and EU/UK. The successful candidate will be an expert in state and federal privacy laws and comfortable advising a fast-growing, technology-driven organisation.
Key Responsibilities
The role will include advising the business on US state privacy laws (e.g., CCPA) and federal/state sectoral privacy laws (e.g., GLBA, FTC Act, ECPA, BIPA, CUBI). Specifically, the US Privacy Counsel will:
- Respond to ad-hoc privacy queries from across the business and conduct risk assessments as required.
- Coordinate advice with other legal teams, including marketing and commercial.
- Advise on consumer privacy-related complaints and requests.
- Respond to privacy-related inquiries from regulators and assist with law-enforcement requests.
- Advise on US data transfer restrictions.
- Update and maintain the organisation’s suite of US privacy notices.
- Partner with the compliance function to identify and remediate compliance gaps.
- Monitor and advise on new US state and federal laws, regulatory developments, and case law.
- Advise on security incidents and data breaches, including assessing FTC and state notification obligations.
- Engage with regulators, industry groups, and public consultations.
Collaboration
The role will involve close coordination with EU/UK privacy lawyers to ensure aligned, streamlined advice across a global business operating in a rapidly evolving regulatory landscape.
Candidate Profile
- US Attorney/Lawyer based in New York
- Strong knowledge of US privacy and data protection laws.
- Experience advising on privacy issues within financial services, technology, or fast-paced digital environments is advantageous.
- Ability to manage complex, cross-functional matters with a pragmatic and business-oriented approach.
- Excellent communication and stakeholder-management skills.
